METASTORM TERMS OF SERVICE

 

Metastorm provides this online community as a service to its customers and partners, to help them exchange ideas, tips, information, and techniques related to our software. This online community is here for the enjoyment and benefit of all members, and is accessible to all who register. Like any community, they are most valuable when everyone obeys certain basic guidelines and rules for online behavior. These guidelines and rules are presented here so that you know what is expected of you and what you can expect from other participants when using the online community. PLEASE READ THESE TERMS OF SERVICE CAREFULLY.  By registering you agree to follow these Usage Guidelines, in addition to the Legal Terms & Conditions which can be found at the end of this document. 

 

Usage Guidelines

• We are here to help.  If you are new to this online community and are unsure about anything, just ask! The moderators and other participants are always happy to help. Metastorm moderators are identified by a "MOD" or “ADMIN” icon.
• Keep it productive.  This online community is designed to provide a place for customers and partners to help each other.   For obtaining assistance directly from Metastorm, please take advantage of the phone or email options available on the support page or our website.
• Keep it relevant.  For everyone's benefit please stay on topic. This online community is provided for the specific purpose of making it possible for the customers and partners of Metastorm to help each other in using Metastorm products and services. Please refrain from discussing personal matters, abusing any company or product, or, in general, from posting in a manner unrelated to the direct resolution of issues expected in the support of Metastorm products and services.
• Keep it courteous.  Everyone wants to have a positive experience while on the online community - please make sure that you are not detracting from any other user's experience. In particular, please refrain from posting anything unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, harassing, threatening, harmful, invasive of privacy or publicity rights, abusive, inflammatory or otherwise objectionable or injurious to third parties. Your opinions are always welcome, but personal attacks and harassment ("flaming") in either the online community or through private messaging are not acceptable.
• Keep it spam-free.  This community is provided as a service to Metastorm customers and partners and is not intended for the promotion of third party services, products, websites, or organizations. Please refrain from posting content that would constitute advertising, junk mail, spam, chain letters, or any other form of unauthorized solicitation.
• Keep it legal.  It is unacceptable to post any material (i) that would infringe on any patent, trademark, trade secret, copyright, or other proprietary rights of any party, (ii) that contains software viruses or any other computer code or files that are designed to disrupt, damage, or limit the functioning of any software or hardware, or (iii) that is deemed to be illegal by any local, state, federal, or international law.
• Be careful.  Most people are happy to help out on this online community, but remember that their advice is theirs only and that you are responsible for deciding whether or not to follow it. If the advice given by a user sounds wrong to you, do not try it. In particular, if any user asks you for personal information, such as an account number, address, password or credit card number, do not provide it.
• Metastorm retains the right to remove content and limit users' access.  Metastorm does not generally edit or monitor content posted by participants in its online community; however, Metastorm retains the right, at its sole discretion, to limit users' access to the online community and to remove material that, in Metastorm' sole judgment, does not comply with the present Usage Guidelines or with the Legal Terms & Conditions, or that is otherwise inappropriate for this online community, harmful, objectionable, or inaccurate. Metastorm also retains the right to assign such right to some members of the community. Metastorm is not responsible for any failure or delay in removing such material.  Moderators may take any action they deem necessary in their own judgment to support the Usage Guidelines and Legal Terms & Conditions, and, in general, that can detract from the experience of other users or the purpose of the support community. Such actions may include editing or deleting material and banning individual users.
• Disclaimer of Warranties and Limitation of Liability.  Members like you are providing most of the material in this online community. Such third-party content is the sole responsibility of the person originating the material. Metastorm does not control and is not responsible for this third-party material.  Metastorm does not warrant or guarantee the accuracy, reliability, completeness, usefulness, non-infringement on intellectual property rights, or quality of any material in the online community, regardless of who originates that material. You expressly understand and agree that you bear all risks associated with using or relying on the material. Metastorm will not be liable or responsible in any way for any content in the online community, including, but not limited to, any errors or omissions in the material, or for any losses or damage of any kind incurred as a result of the use of or reliance on any material.

1. Rules and Regulations
   The following rules and regulations apply to all visitors to or users of Metastorm’s online community. By accessing this Web Site, user acknowledges acceptance of these terms and conditions.  These terms and conditions are not exhaustive.  Metastorm reserves the right to change these rules and regulations from time to time at its sole discretion. In the case of any violation of these rules and regulations, Metastorm reserves the right to suspend or terminate your right to access the Metastorm online community.  In addition, Metastorm reserves the right to seek all remedies available by law and in equity for such violations. These rules and regulations apply to all visits to the Metastorm online community, both now and in the future.
2. Limited License
   Metastorm hereby authorizes you to copy materials published by Metastorm on this Web Site solely for non-commercial use within your organization (or if you are a Metastorm partner, your customer's organization) in support of Metastorm products. No other use of the information is authorized. In consideration of this authorization, you agree that any copy of these materials which you make shall retain all copyright and other proprietary notices in the same form and manner as on the original. Except as specified above, nothing contained herein shall be construed as conferring by implication, or otherwise any license or right under any patent, trademark or copyright of Metastorm or any third party.  USERS ARE NOT PERMITTED TO MODIFY, DISTRIBUTE, PUBLISH, TRANSMIT OR CREATE DERIVATIVE WORKS OF ANY MATERIAL FOUND ON THIS SITE FOR ANY PUBLIC OR COMMERCIAL PURPOSES.
3. Compliance With Applicable Laws; Export Control Laws
   User access to the Metastorm online community is governed by all applicable federal, state and local laws. All information available within the online community is subject to U.S. export control laws and may also be subject to the laws of the country where you reside. All Metastorm products and publications are commercial in nature. Use duplication, or disclosure by the United States Government is subject to the restrictions set forth in DFARS 252.227-7015 and FAR 52.227-19.
4. Trademarks
   The trademarks, logos and service marks ("Marks") displayed within Metastorm online community are the property of Metastorm or other third parties. Users are not permitted to use these Marks without the prior written consent of Metastorm or such third party which may own the Mark. Please see the current list of Metastorm Trademarks below.
5. General Disclaimer
   Metastorm will provide online community moderators.  Official Metastorm content will be posted only by users identified as Metastorm users.  Metastorm is not responsible for content posted by any user who is not designated as a Metastorm user.
   Although Metastorm will attempt to insure that accurate information is posted within the online community, Metastorm assumes no responsibility for the accuracy of the information.   Metastorm Technical Support can be contacted directly.   ALL INFORMATION PROVIDED ON THIS WEB SITE IS PROVIDED "AS IS" WITH ALL FAULTS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED.    Content included at this site and provided by or on behalf of Metastorm (including but not limited to text, graphics, logos, images and online community posts) is the exclusive property of Metastorm. By submitting your content to Metastorm’s online community Posts (including, but not limited to sending messages through this Web Site or through other applicable websites or posting messages to discussion boards, and chat rooms), you hereby grant to Metastorm a worldwide, perpetual, irrevocable, royalty-free and fully-paid, freely transferable, sub-licenseable (through multiple tiers) right to exercise all copyright, publicity, and moral rights, in any media now known or not currently known, with respect to any content you provide to us in any public space on this Web Site or other Metastorm online community web sites or in any e-mail that you provide to us through this Web Site or any other Metastorm online community web sites. Metastorm reserves the right to add, delete, edit, modify, and take any other action Metastorm deems necessary to preserve the integrity of all online community Posts.
7. Enforcement
   Metastorm reserves the right to investigate any violation of the Metastorm terms and conditions in this online community and to take appropriate action.  Metastorm has absolute discretion to enforce the terms of these documents.  Remedial action may include, but is not limited to warning users, suspending access to Metastorm online community, deleting or editing any content.  Metastorm may request that a user delete, edit, or re-submit any inappropriate content.  To report violations, please contact the Metastorm online community moderators.  Please include the message board name and the link of the post in question.
8. Cookies
   The Metastorm Cookie Policy is defined in our Privacy Policy. You do not need to have cookies turned on to view online community postings. However, with cookies turned off or if you do not accept the cookie from the online community, you will not be permitted to sign onto the Metastorm online community to post content or respond to postings.
9. International Site Use
   The Metastorm online community is designed for our worldwide customers and partners.  All online community content is in English. 
10. Links to Third Party Sites
    Metastorm online community may contain links to third party sites. Access to any other Internet site linked to this Web Site is at the user's own risk and Metastorm is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these sites. Metastorm provides these links merely as a convenience and the inclusion of such links does not imply an endorsement.  Any links posted by you are subject to all terms and conditions like any other type of content posted to the Metastorm online community.  You may not post a link in the online community that directs users to any content or information that would constitute a violation of the terms and conditions.
11. General Guidelines
    Use of the Metastorm online community is at your own risk.  Do not post any information that you do not wish to make public.  Any information that you post can be obtained and used by others.  You post at your own risk.  It is not possible to be certain that fellow online community users are who they say they are.
12. Access to Password Protected/Secure Areas
    Access to and use of password protected and/or secure areas of the Web Site is restricted to authorized users only. Unauthorized individuals attempting to access these areas of the Web Site may be subject to prosecution.
