This war file is required.
Check if the file is present in workarea mentioned:
/iwmnt/iwadmin/main/spars/WORKAREA/Installed/foundation/toolkit/foundation.tk.war

If the file is present, you do not have sufficient permissions on this workarea or the folder due to which File is not found. Give yourself required permissions and problem will be resolved.

I am trying to fix the existing installtion on a beta box
the file /iwmnt/iwadmin/main/spars/WORKAREA/Installed/foundation/toolkit/foundation.tk.war is not exisitent either on prod and dev environments also. there is no folder called spars under /iwmnt/iwadmin/main/

I dont know if you can find this out from documentation or not...
But i have done multiple Teamsite 7.x installations and this branch is created automatically every time.

just to mention, we do not use sitepublisher/livesite, could it be because of some selections during installtion this is optionally created?

It might be true. SPAR is actually package for Sitepublisher components.
BUT i am not sure why Interwoven has created this kind of stucture where rebuilding the system requires some files from a WORKAREA.

I will try to comment the following line from /iw-home/TeamSite/local/config/lib/content_center/toolkits.xml and try rebuiliding content center
