PathSpecification fails using edition:INITIAL ?

I have a teamsite edition comparison based deployment in which i specify the following value in the pathspecification section:
<pathSpecification>
<path name = "application/userreg/xml" />
</pathSpecification>
Everything will work fine as long as both the editions which are being compared have the above mentioned directory in them.
If i specify INITIAL ( which is empty) as the base edition so that all contents from my latest edition get deployed, i get the following error:
ERROR: Error locating /default/main/scb2bex_r3_appl/EDITION/INITIAL/application/userreg/xml/.
Naturally so as the INITIAL edition is empty ........ so is this the behavior to expect from OpenDeploy ? If so then what are the work arounds for this ?

Sorry, I meant to post but it's difficult when splitting time with all the work I'm doing for my customer and trying to keep up with all these forums and my email...
I was able to reproduce a similar problem (not entirely the same) with 5.6 and logged it as a bug (don't remember the number off-hand, don't have time right now to look it up) - you should probably contact Interwoven Support and (a) see if they can verify the problem in 5.5.1, (b) if so, to either file a new bug report specifically for your case - or find the one I filed and add your organization to the list of interested parties.
