I would run select * from DTREEACL where DATAID=38075 and see if something bad has happened like (no owner etc, negative), etc is happening. In some organizations, they will remove owner and owner group and public access totally and rely on Assigned Access below the ACL(it actually is much better) ACLType=1 is what you are targeting. If not put connect logs against that instance and most likely you will see the actual error.
